Step-by-Step Guide
Notify the state bar
Contact the state bar association where the attorney was licensed to report the death. Most bars require notification within 30 days with a copy of the death certificate.
Secure IOLTA and trust accounts
IOLTA accounts hold client funds only. Contact the state bar ethics hotline and the bank immediately. These funds must be returned to clients or transferred to successor counsel.
Notify active clients
Send written notice to all active clients advising them to retain new counsel. Return all client files and property. Document everything.
Close or transfer active cases
Work with the court to substitute counsel on pending matters. File appropriate motions in each case. Courts may appoint a custodian for the practice.
Surrender the license
Complete the bar's formal surrender process. Notify malpractice insurance carrier — tail coverage may be needed to protect the estate from future claims.
