Final W-2 needed for deceased's last tax return

Step-by-Step Guide

1

Request the final paycheck

Contact the employer to request the final paycheck, which should include all wages earned through the date of death. State laws govern how quickly the final paycheck must be issued — in many states, it is due within a few days of the request. Ask that it be made payable to the estate.

Estimated time: Immediately

2

Claim unused PTO and vacation payout

Many states require employers to pay out unused vacation and PTO upon separation. Ask HR about the company's PTO payout policy and state law requirements. Document the number of unused days and the daily rate.

Estimated time: 1-2 pay cycles

3

Request pending bonuses and commissions

Ask about any earned but unpaid bonuses, commissions, or incentive compensation. Review the deceased's employment agreement and compensation plan for details on what is owed. Some plans have specific provisions for death.

4

Obtain tax documents

Request copies of all available W-2s and pay stubs. The employer will issue a final W-2 for the year of death, which is needed to file the deceased's final tax return. Ask when it will be available and where it will be mailed.

Estimated time: January of following year for W-2
